N.F.W. GROUP INC. DOES NOT WARRANT THAT THE SERVICES, THEIR SERVERS, OR EMAIL SENT FROM N.F.W. GROUP INC. ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. N.F.W. GROUP INC. WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.  

7. Limitation of Liability  

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL N.F.W. GROUP INC., KINGSHIP HOLDINGS INC., THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, YOUR INABILITY TO USE THE SERVICES, OR THESE TERMS, EVEN IF N.F.W. GROUP INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF N.F.W. GROUP INC. TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO N.F.W. GROUP INC. FOR THE SPECIFIC PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM WITHIN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE THE CLAIM AROSE.

8. Indemnification

You agree to indemnify, defend, and hold harmless N.F.W. Group Inc., KINGSHIP HOLDINGS INC., their affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your use of the Services.  

9. Governing Law and Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.  

Any dispute arising out of or relating to these Terms or the Services shall be exclusively resolved in the state or federal courts located in [Specify Jurisdiction, e.g., Union County, New Jersey]. You hereby consent to the personal jurisdiction of such courts.  

10. Termination

We reserve the right to terminate or suspend your access to all or part of the Services at any time, with or without cause and without notice. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and N.F.W. Group Inc. with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and N.F.W. Group Inc.
