RISE Mobile App Terms of Service

Acceptance of Terms

By downloading, installing, or using the RISE mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

RISE is a fitness and wellness tracking application that allows users to log workouts, track nutrition, monitor fasting protocols, record progress photos and videos, and share fitness achievements. The App is provided by No Feelings Wellness Group Inc. ("we," "us," "our"), a subsidiary of Kingship Holdings Inc.

Account Registration

You must create an account to use the App. You agree to provide accurate and complete information during registration, keep your login credentials secure, notify us immediately of any unauthorized use of your account, and accept responsibility for all activity that occurs under your account.

User Conduct

You agree not to use the App for any unlawful purpose, upload content that is offensive, harmful, or infringes on the rights of others, attempt to gain unauthorized access to the App or its systems, reverse engineer, decompile, or disassemble the App, or use the App to distribute malware, spam, or other harmful content.

Health and Fitness Disclaimer

RISE is a tracking and logging tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The exercise descriptions, nutrition data, macro calculations, and fasting protocols provided in the App are for informational purposes only. Consult a qualified healthcare professional before beginning any exercise or nutrition program. We are not responsible for any injury, health issue, or adverse effect resulting from the use of information provided in the App. By using the App, you acknowledge that you participate in fitness activities at your own risk.

User Content

You retain ownership of all content you create or upload to the App, including workout logs, progress photos, videos, and custom food entries. By using the App's sharing features, you grant us a limited, non-exclusive license to display your shared content as necessary to provide the sharing functionality. We do not claim ownership of your content and will not use it for marketing or promotional purposes without your explicit consent.

Intellectual Property

The RISE name, logo, design, and all associated branding are the property of No Feelings Wellness Group Inc. and Kingship Holdings Inc. The App's code, design, exercise database, food database, and all other original content are protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App or its content without written permission.

Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. We do not guarantee uninterrupted or error-free operation of the App.

Limitation of Liability

To the maximum extent permitted by law, No Feelings Wellness Group Inc. and Kingship Holdings Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, inability to use the App, any content or data loss, any injury or health issue related to fitness activities, or any unauthorized access to your account or data. Our total liability for any claim related to the App shall not exceed the amount you paid to use the App in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless No Feelings Wellness Group Inc., Kingship Holdings Inc., and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately. We may delete your data following account termination in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
